Privacy Policy for EBTax
This "Privacy Policy" explains how JHESSCO LLC, doing business as NolaByte ("Company" or "we") collects, uses, discloses, and otherwise processes personal data on behalf of our customers — typically, merchants (any, a "Merchant") — in connection with our application, EBTax, which runs on the Clover Point of Sale system ("Clover POS"). This Privacy Policy does not apply to Company's privacy practices in any other context.
Company's processing of personal data in connection with our application is governed by this Privacy Policy and our agreements with Merchants. In the event of any conflict between this Privacy Policy and a customer agreement, the customer agreement will control to the extent permitted by applicable law.
This Privacy Policy is not a substitute for any privacy policy that a Merchant may be required to provide to their customers, personnel, or other individuals.
Summary
EBTax operates entirely on the Merchant's Clover device and within the Merchant's own Clover account. The application has no ability to connect to the Internet on its own, and Company does not receive, collect, store, sell, or transmit any Merchant data or any personal data to Company's own systems or to any third party.
Information the application processes
EBTax processes the following information locally on the Merchant's Clover device, using the Clover POS platform's own secure interfaces:
- Inventory data: item names, prices, categories, and item labels from the Merchant's Clover inventory, so the Merchant can designate items as EBT-eligible.
- Order data: line items on the Merchant's open orders (item names, prices, and quantities), so the application can apply sales tax exemptions to EBT-eligible items when the Merchant requests it.
This information is read from and written to the Merchant's own Clover account through the Clover POS platform. It remains within the Clover platform at all times and is never transmitted to Company.
EBTax does not access, collect, or process:
- Customer names, payment card numbers, EBT card numbers, or any other payment credentials
- Customer contact information (email addresses, phone numbers, or physical addresses)
- Merchant personnel information (employee names, shifts, hours, or sales history)
- Location data, device identifiers used for tracking, or analytics data
How we use the information
The application uses the inventory and order data described above solely on the Merchant's device, to provide the application's functionality: designating EBT-eligible items and applying sales tax exemptions to orders. Company itself does not receive or use this information for any purpose, including research, analytics, advertising, or product improvement.
If a Merchant contacts Company for support, Company will use the contact information and any details the Merchant chooses to provide solely to respond to the inquiry.
How we share information
Company does not receive Merchant or customer personal data through the application, and therefore does not share, sell, rent, or disclose any such data to third parties.
Data the application processes remains within the Clover POS platform, which is operated by Clover. You may view Clover's Privacy Notice at https://www.clover.com/privacy-policy.
Company may disclose information it holds (such as support correspondence) to government or law enforcement officials or private parties as required by law, and as we believe necessary or appropriate to (a) comply with applicable laws and lawful requests and legal processes, such as to respond to subpoenas or requests from government authorities; (b) enforce the terms and conditions that govern our application; (c) protect our rights, privacy, safety or property, and/or that of you or others; and (d) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.
Company may sell or transfer some or all of its business or assets, including information it holds, in connection with a business transaction (or potential business transaction) such as a merger, consolidation, acquisition, reorganization or sale of assets or in the event of bankruptcy, in which case we will make reasonable efforts to require the recipient to honor this Privacy Policy.
Your rights and choices
Data subject rights
To the extent that applicable law provides individuals with rights pertaining to their personal information, such as to review and request changes to their personal information, individuals should contact the Merchant with any requests pertaining to the Merchant's use of our application. To the extent that Clover is responsible for responding to data subject rights requests under applicable law, individuals may contact Clover with applicable requests as explained in Clover's Privacy Notice, https://www.clover.com/privacy-policy. Company will assist a Merchant, or Clover, as applicable, in responding to such requests subject to our contract with a Merchant or Clover. Because Company does not hold Merchant or customer personal data, there is typically no data for Company to access, correct, or delete.
